Knoxville, TN, February 14, 2008 -- Lewis King Shareholders R. Loy Waldrop, David N. Garst, John J. Britton and John R. Tarpley are recognized in the 25th edition of Best Lawyers in America® 2008. Selection to this list is based on evaluations and nominations by lawyers. R. Loy Waldrop – Construction
Loy Waldrop is engaged in an extensive construction law practice from the firm’s Knoxville office. In this area of legal services where he practices exclusively, Mr. Waldrop, who has an engineering degree, has represented contractors, designers and owners in a wide variety of legal matters ranging from payment claims and contract negotiations to significant construction litigation involving claims over 100 million dollars and multiple parties. He has approximately 30 years experience in construction law and has been involved in dozens of construction dispute trials and arbitrations as lead counsel for his clients. Mr. Waldrop places a strong emphasis on early analysis and resolution of construction disputes when it is reasonable and practical to use negotiation and mediation as means to achieve his client’s goals.
David N. Garst – Construction
David N. Garst, of the firm’s Nashville office, practices principally in the areas of architects' and engineers' professional liability, construction defect litigation, construction contract law, and commercial litigation. For more than 20 years, Mr. Garst has represented contractors, subcontractors, suppliers, architects, engineers, surveyors, building owners, and developers on a variety of projects both locally and regionally. His experience includes claims and litigation over many project types, including commercial, industrial, retail, medical, and residential buildings, subdivisions and industrial parks, water and wastewater plants and facilities, school and university facilities and so on.
Mr. Garst was President of the Tennessee Association of Construction Counsel from 2003 through 2005 and now serves on the Board. Mr. Garst received a Bachelor of Architecture degree from the University of Tennessee in 1981 and a Juris Doctorate degree from Memphis State University (now the University of Memphis) in 1986.
John Britton – Eminent Domain and Condemnation
John J. Britton, a shareholder in the Knoxville office, represents both condemning authorities seeking to acquire property as well as individuals and businesses whose property or property rights are being taken by condemnation. Mr. Britton originally began his career, in this area of law, when he served as an Assistant Attorney General for the State of Tennessee representing the Department of Transportation. During his career, he has handled condemnation matters in most of the counties in eastern and middle Tennessee.
Mr. Britton is also a trial defense lawyer who practices in the areas of personal injury, workers’ compensation and employment law. Mr. Britton was listed in the 2007 edition of Best Lawyers®, the first year it recognized lawyers in the area of Eminent Domain and Condemnation.
John R. Tarpley – Product Liability Litigation
John Tarpley, managing shareholder of the firm’s Nashville office, has been involved in complex litigation in the areas of product and professional liability, transportation, commercial law, construction defect, tort and casualty defense. Mr. Tarpley has successfully defended trucking companies and their employees at trial and mediation of claims. Mr. Tarpley has been certified as a general civil mediator by the Alternative Dispute Resolution Commission of the Tennessee Supreme Court.
Prior to joining the firm in 1989, Mr. Tarpley was a judicial clerk for the Tennessee Court of Appeals, Middle Division, from 1981 to 1982, and an assistant attorney general for the State of Tennessee from 1982 to 1989. Mr. Tarpley is a former President of the Tennessee Bar Association and has served on the TBA’s Executive Committee for a number of years.
